This is one of our most asked questions. You prefer to have options if you’re like me; however, your options are limited in some states and utterly absent in others. I could get into that further, but honestly, that’s a whole other topic, and I forgot my soapbox at home. Hopefully, one day we as a nation can come together on this topic. Until then, we are stuck with our current fractured system. Which is why we get asked a lot – how is D9 legal?
2018 Farm Bill
Well, the short answer is hemp. With the 2018 Farm Bill, hemp with a total dry weight of 0.3% or less D9 THC is LEGAL at the federal level (the bill specifically calls out Delta-9 and all it’s derivatives, cannabinoids, isomers, extracts, acids, salts, and salts of isomers, whether growing or not). So not only is the hemp flower legal, but so are any products made with it or its extracts and derivatives like D9, D10, D8, CBD, and so on. This means any products that contain hemp or its derivatives are legal, as long as the starting material’s total dry weight D9 THC content is less than 0.3%. A nice little “legal loophole,” if you will.
Even further, we’re only limited to D9 as a restriction in most states. The wording in the federal bill does not explicitly call out other cannabinoids. It should be noted that some states have enacted laws to restrict industrial hemp further. As of May 2020, Arkansas, Minnesota, Rhode Island, and Oregon are considered total THC states. Any amount of total THC over 0.3% is deemed high-THC cannabis and is therefore illegal or requires a medical prescription. Lastly, in Idaho, New Hampshire, and South Dakota, any amount of THC is illegal.
Industrial Hemp Industry In Flux
One of the more intruiging things happening right now is all the canna-chemistry, as I call it. In most states, we can now use the scientific method more freely with our favorite plant with the updated legislation—specifically, industrial hemp. Now more than ever, new methods are being developed to process cannabis and its several hundred compounds (including new ones we’re still discovering). New extraction methods, new conversion methods, all sorts of beautiful things happening. All thanks to the 2014 and 2018 Farm Bills.
While it’s nice to have this opportunity, it could also be at risk of being taken away. I know you’re here because you’re wondering how is D9 even legal, but it might not be forever. If anything is guaranteed, it’s change. So if you enjoy all Delta-9 has to offer, your best bet is to stock up now. After you’re stocked up, the next thing you can do is communicate with your local legislators and vote for the right "canna-dates."
